Kamiński case reviewed for ‘technical ruling’

The District Court in Warsaw has referred the case of ex-anticorruption chief Mariusz Kamiński to the Regional Court to examine a precedent set by President Andrzej Duda when he pardoned Kamiński before the ruling of the court of last instance.

The court of second instance will now hear the case of the former head of the Central Anticorruption Bureau (CBA) and his former three subordinates, who were pardoned by President Andrzej Duda in November.
The judges will issue a technical ruling, which will have no implications for the former defendant, however.
The presidential pardon set forth a precedent “which requires a thorough analysis as it sets a pattern for future conduct,” says spokesperson for the regional court Ewa Leszczyńska-Furtak, adding that the judges may request an interpretation from the Supreme Court.
Leszczyńska-Furtak, meanwhile, asserted that the pardon itself was not under scrutiny, “but the stage of proceedings at which that the presidential privilege was applied.”
Mariusz Kamiński, accused of abusing office while heading CBA 2007-2009, was sentenced last March to three years in prison and a ten-year ban on holding public office.
While his non-binding verdict had been pending appeal, President Andrzej Duda pardoned Kamiński, a day after the latter was appointed Member of the Council of Ministers as a coordinator of special services. (aba/rk)
